Terms of Service
Acceptance of Terms
Welcome to coffeeandtheory.com (the “Site”). The Site is owned and operated by Coffee and Theory (“Coffee & Theory,” “we,” or “us”). By accessing or using our website and the educational resources, products, and services we provide (collectively, the “Services”), you agree to be bound by these Terms of Service (this “Agreement” or “Terms”). These Terms apply to all visitors, users, and others who access the Site or use our Services. If you do not agree with these Terms, you should not use the Site or any Services.
Please also review our Privacy Policy (if available) to understand how we collect and use information. This Agreement is effective as of June 13, 2025.
(Note: We reserve the right to update or change these Terms from time to time. See “Changes to These Terms” below.)
Description of Services
Coffee and Theory is an educational platform offering a variety of resources for teachers, parents, coaches, and educators in a range of fields. Our Services include both free and paid materials designed to support teaching and learning. These resources may include, for example, printable activities, educational articles, videos or online courses, and other instructional content. We aim to provide high-quality content to help a range of educators and parents enhance the learning experience.
From time to time, we may introduce new features, expand our resource library, or modify the way we deliver our content. We reserve the right to add, change, or discontinue any aspect of the Services at our discretion, without prior notice. We will strive to clearly communicate any major changes that affect how you use our Services.
User Responsibilities and Conduct
By using coffeeandtheory.com, you agree to use our Site and Services responsibly and only for their intended purposes, in compliance with these Terms and all applicable laws and regulations. Specifically, you agree that:
-
Accurate Information: If you create an account or provide information to us in any way, you will supply accurate, current, and complete information. You will promptly update your information if it changes.
-
Account Security: If you register for an account, you are responsible for maintaining the confidentiality of your login credentials. Do not share your username or password with others. You are responsible for all activities that occur under your account. If you suspect any unauthorized use of your account, notify us immediately.
-
Authorized Access: Access our Services only through the channels we provide. You agree not to try to access the Site, Services, or any related systems through unauthorized means (for example, hacking, scraping, or using automated tools not approved by us). Any attempt to bypass security or access restrictions on the Site is strictly prohibited.
-
Prohibited Activities: You will not engage in any activity that interferes with or disrupts the Site or the servers and networks that host the Site. This includes any attempt to compromise the functionality of the Site, deploy malicious code, or overload the infrastructure.
-
No Resale or Misuse of Content: You will not copy, reproduce, duplicate, sell, trade, or resell our resources or content without explicit permission from Coffee and Theory. The materials provided are for your personal and educational use. Redistributing or repackaging our content (especially for commercial gain) is not allowed unless we have given you written consent.
-
Consequences of Violation: You are responsible for any losses, damages, or consequences that Coffee and Theory incurs due to your misuse of the Site or violation of these Terms. Such violations could also result in the suspension or termination of your access to the Services (see “Termination” below) and may subject you to legal liability.
Interactive Features: If our Site offers any interactive features such as blog comments, discussion forums, or social media integrations, you agree to use these features in a respectful and lawful manner. You are solely responsible for any content you post or actions you take on these platforms. In particular, you agree that you will NOT post, upload, share, or transmit any content that:
-
Is unlawful, threatening, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, offensive, or obscene. This includes content that is hateful, discriminatory or contains any form of inappropriate language or imagery.
-
Infringes upon intellectual property rights or other proprietary rights of any party. For example, do not post content (text, images, video, etc.) that you don’t have the right to share.
-
Constitutes unauthorized advertising or spam. This means no posting of promotional materials or links that are unrelated to the educational topics at hand, and no repetitive or unsolicited messages.
-
Impersonates any person or entity, or falsely states or misrepresents your affiliation with a person or entity. Always be honest about your identity when interacting on our Site.
Coffee and Theory reserves the right (but not the obligation) to remove or delete any user-generated content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable. We are not responsible for any failure or delay in removing such content. If we remove content that you have posted because it violates these rules, you agree that we are not liable to you or anyone else for that removal.
User-Posted Content and License: We do not claim ownership of content that you post on open areas of the Site (such as comments or forums). However, by submitting or posting content through our interactive features, you grant Coffee and Theory a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display that content. This license is needed so that we can display your contributions on our Site and make backups or promotional use of content as needed. This license does not apply to information you provide to us privately (for example, during account registration or contact forms); any personal information you provide is handled according to our Privacy Policy.
(For clarity: content you post publicly remains yours, but you give us permission to use it. And any private account or personal information you give us is governed by our Privacy practices.)
Intellectual Property Rights
All content, materials, and features available on coffeeandtheory.com — including but not limited to text, graphics, logos, images, audio/video clips, digital downloads, compilations, and software — are the intellectual property of Coffee and Theory or our content suppliers and are protected by applicable copyright, trademark, and other intellectual property laws. This includes the overall design, layout, look-and-feel, and arrangement of our Site.
Limited License for Personal Use: Coffee and Theory grants you a limited, non-transferable, non-exclusive license to access and use the content on our Site for your personal, non-commercial use (for example, using a free worksheet in your own classroom or at home with your children). Except as expressly allowed, you may not reproduce, distribute, modify, create derivative works from, publicly display, or publicly perform any of our content without prior written permission from Coffee and Theory or the appropriate rights holder.
Trademarks: The Coffee and Theory name, logo, and any product or service names or slogans on the Site are trademarks of Coffee and Theory. You must not use any of these trademarks without our prior written consent. All other trademarks appearing on the Site that are not owned by Coffee and Theory are the property of their respective owners.
If you wish to quote, reference, or share our content beyond what is permitted by fair use or the above license, please contact us for permission. We value educators sharing knowledge, but we also must protect the rights of creators who contribute to our platform.
Payment, Refunds, and Account Terms
Some of our Services are offered for free, while others are available for purchase or require an account. The following terms apply to purchases, refunds, and accounts on Coffee and Theory:
Payments: When you purchase a paid resource or enroll in a paid service (such as a course or premium content) on coffeeandtheory.com, you agree to provide a valid payment method (such as a credit card or other accepted payment mechanism) and authorize us or our third-party payment processors to charge the listed fees for the item or service. All prices are stated in Euros (EUR) unless otherwise specified, and applicable VAT may be added where required by law. You are responsible for all charges and any applicable fees (e.g., taxes or transaction fees) associated with your purchase. We reserve the right to change the pricing of our Services or introduce new charges, but no price change will affect you retroactively for a purchase you’ve already completed.
Refund Policy: Because many of our products are digital goods (which are accessible immediately upon purchase or download), all sales are final. Once you have been granted access to digital content or have downloaded a resource, we typically cannot offer a refund. This is to protect the value of our content and prevent misuse. However, we want you to be satisfied with your experience. If you encounter a technical problem with a resource or believe there was an error with your purchase, please contact us at will@coffeeandtheory.com within 14 days of your purchase. We will review refund requests on a case-by-case basis, and in our sole discretion we may issue a refund or credit if the circumstances warrant (for example, if a file is corrupt and we cannot provide a working replacement). Refunds, if issued, will be processed to the original method of payment whenever possible. This refund policy does not affect any rights you may have under consumer protection laws.
Account Creation and Security: Certain features (such as purchasing, accessing restricted content, or commenting) may require you to create a user account. Eligibility: You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account on Coffee and Theory or to make purchases. If you are under 18, you may use the free educational resources on our Site under the supervision of a parent or guardian, but the adult will be responsible for any transactions. When creating an account, you agree to provide truthful and complete information. You also agree to keep your account information updated if it changes. One Person per Account: Each account is meant for a single user. Do not share your account credentials or give others access to your account. You are responsible for any activity that occurs under your account (even if it’s someone else using your credentials), so please safeguard your username and password.
Account Termination: We reserve the right to suspend or terminate your account (or access to certain features) at our discretion if we determine that you have violated these Terms or engaged in fraudulent or unlawful behavior. In such cases, we may also restrict your future access to the Services. (See also “Termination” below for more details on termination of service.)
Third-Party Links
Our Site and Services may include links to third-party websites or services that are not owned or controlled by Coffee and Theory. These links are provided for convenience or reference (for example, citing an educational article or recommending a tool), but they do not signify an endorsement by Coffee and Theory. We have no control over the content, policies, or practices of any third-party websites.
External Sites: If you follow a link to an external website, you do so at your own risk. Be aware that third-party sites have their own terms of use and privacy policies, and we are not responsible for the content or practices of those sites. Visiting or interacting with those sites is subject to their rules, not ours.
Transactions with Third Parties: Any dealings you have with third parties (such as other websites or service providers) found on or through our Site are between you and that third party. Coffee and Theory is not liable for any loss or damage incurred as a result of such dealings. If you purchase a product or service from a third-party site linked from Coffee and Theory, the transaction is strictly between you and that third party.
We encourage you to exercise caution and read the terms and privacy statements of any other website you visit via links from our Site.
Disclaimer of Warranties
Coffee and Theory provides the Site and all Services on an “as is” and “as available” basis, without any warranties of any kind. Using our Site is at your sole risk. To the fullest extent permitted by law, Coffee and Theory disclaims all warranties, express or implied, in connection with the Site and your use of it. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our Services will be suitable for your needs or that they will be uninterrupted or error-free.
In particular, we make no guarantees or warranties that:
-
Suitability: The Services (or any content obtained through the Services) will meet your requirements or expectations.
-
Availability: The Site will be uninterrupted, timely, secure, or free from errors or technical issues. We cannot promise that our content is accessible at all times or that any reported problems will be corrected immediately.
-
Accuracy: The information or results obtained from your use of the Services will be accurate, complete, or reliable. While we strive for quality and accuracy in our educational content, Coffee and Theory does not warrant or guarantee the effectiveness of any resource in achieving any specific learning outcomes.
-
Defects: Any errors or defects in the operation of the Site or the materials will be corrected. We continuously work to maintain and improve our Services, but we make no warranty that the Site will be free of viruses or other harmful components.
You understand and agree that any material downloaded or obtained through the use of our Site is done at your own discretion and risk. Coffee and Theory is not responsible for any damage to your computer system, device, or data that results from the download or use of our content or Services.
No advice or information (whether oral or written) obtained by you from Coffee and Theory or through the Services shall create any warranty not expressly stated in these Terms. We want our resources to be helpful, but we cannot guarantee any specific results, and we provide no professional advice or warranty beyond the general information for educational purposes.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above disclaimers may not apply to you. In such cases, any warranties required by law are limited to the shortest period allowed by law.
Limitation of Liability
To the maximum extent permitted by law, Coffee and Theory (including our owners, team members, partners, and affiliates) shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of (or inability to use) the Site or our Services. This limitation of liability applies to any damages for lost profits, lost data, loss of goodwill, business interruption, accuracy of results, or computer failure or malfunction, even if we have been advised or should have known of the possibility of such damages.
In particular, Coffee and Theory will not be liable for any loss or damage that may result from: (1) any errors, mistakes, or inaccuracies in our content; (2) your reliance on any content obtained through the Site; (3) unauthorized access to or use of our servers and/or any personal information stored therein; (4) any interruption or cessation of transmission to or from our Site; or (5) any bugs, viruses, trojan horses, or other harmful code that may be transmitted to or through our Site by a third party.
Maximum Liability: If, despite the above limitations, Coffee and Theory is found liable for any claim arising out of or related to your use of our Services, our aggregate liability to you shall not exceed the total amount (if any) you have paid to Coffee and Theory for those Services that gave rise to the claim. If you have not paid Coffee and Theory any amounts in the past 6 months, our total liability to you for any claim will be zero. This limitation applies regardless of the form of action (whether in contract, tort, negligence, strict liability, or otherwise) and will survive any termination of this Agreement or your use of the Services.
Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such jurisdictions Coffee and Theory’s liability is limited to the maximum extent permitted by law.
Indemnification
You agree to indemnify and hold harmless Coffee and Theory, its owners, affiliates, partners, contributors, officers, agents, employees, and licensors, from and against any and all losses, expenses, damages, liabilities, claims, demands, or costs (including reasonable attorneys’ fees and legal costs) resulting from or arising out of your use of the Site or Services, your violation of these Terms, or your violation of any law or infringement of any third-party right. This means that if a third party sues or takes action against Coffee and Theory because of something you did (for example, you violated someone else’s copyright using our Site, or you otherwise breached these Terms), you will be responsible for any costs or damages we incur as a result.
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with us in asserting any available defenses. You agree not to settle any such matter without the prior written consent of Coffee and Theory. Your indemnification obligations will survive any termination of your relationship with Coffee and Theory or your use of the Services.
Termination
Coffee and Theory reserves the right to suspend or terminate your access to the Site and Services (including your user account, if you have one), at our sole discretion and without prior notice, if we believe you have violated these Terms or engaged in behavior that we deem harmful, unlawful, or inappropriate. We may also remove any content you have contributed if it violates these Terms or our policies.
If your use of the Site is terminated or suspended, you must immediately stop using the Site and any Services. Any provisions of these Terms which by their nature should survive termination (such as Intellectual Property Rights, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) shall continue to remain in effect even after your access is terminated.
Termination of access or account is in addition to any other remedies that Coffee and Theory may have at law or in equity.
Changes to These Terms
Coffee and Theory may update or modify these Terms of Service from time to time. When we do, we will post the revised Terms on this page and update the “effective date” at the top of the Terms (or indicate the date of the latest revision). It is your responsibility to review these Terms periodically to stay informed of any changes.
If you continue to use the Site or our Services after changes to the Terms are posted, you accept and agree to the modified Terms. If you do not agree with any changes to the Terms, you should discontinue use of the Site and Services. We may, at our discretion, also notify you of significant changes via email or a prominent notice on the Site, but we are not obligated to do so.
